2. Learned counsel for the petitioner seeks permission to make necessary correction in the prayer portion with regard to name of the Court as well as year of the PS Case. Prayer is allowed.

3. Let it be done today itself.

4. The petitioner apprehends arrest in connection with Gardanibagh PS Case No.439 of 2021 dated 11.11.2021, instituted under Sections 457, 380 of the Indian Penal Code.

5. The prosecution case, in brief, is that the informant had gone to his village on the occasion of Chhath Puja and in his absence theft was committed by some unknown persons in which cash of forty-two thousand, gold ornaments, LED TV etc. were stolen.

6. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.45533 of 2025(3) dt.17-10-2025 2/2 petitioner is innocent and has been falsely implicated in this case. The petitioner is not named in the FIR. Only on the basis of confessional statement of one co-accused, Gautam Kumar, the petitioner has been made accused in this case. Nothing incriminating has been recovered either from conscious possession or from the house of the petitioner. It is further submitted that co-accused Gautam Kumar and Ajay Kumar alias Chotey have been granted bail by the Court below itself. Lastly, it is submitted that the petitioner has no criminal antecedents.

7. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, XIV, Patna in Gardanibagh PS Case No.439 of 2021, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

9. The application stands allowed.
