JUSTICE SATYAVRAT VERMA ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Amba P.S. Case No. 109 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.08.2021, he is a person with clean antecedent, charge-sheet has been submitted in this case and allegation is of recovery of 199 litres of liquor out of which 60 litres is alleged to be recovered from a vehicle being driven by the petitioner.

The learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and has no

Learned A.P.P. opposes the bail application.

Considering the fact that petitioner is in custody since 09.08.2021, he is a person with clean antecedent, charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.2,000/- (Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeVII-cum-Special Judge (Excise), Aurangabad, in connection with Amba P.S. Case No. 109 of 2021.

The application stands allowed.
