JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 10-01-2019 Petitioner has filed this writ application challenging the entire proceedings arising out of the departmental proceedings no. 67 of 2012-13 which was initiated vide memo no. 2144/12/15 dated 12.02.2013 against the petitioner for certain charges communicated to him under Praptra 'K' dated 09.10.2013. The charges are in relation to the period when the petitioner was posted as Circle Officer.

This Court would find that the petitioner has approached this Court, without there being any order of punishment against him. Since the final decision is yet to be taken by the

Patna High Court CWJC No.1501 of 2016 dt.10-01-2019 2/2 Disciplinary Authorities pursuant to the proceedings initiated and the enquiry report has already been submitted after conclusion of the proceedings before the Enquiry Officer, it is for the Disciplinary Authority to take a final decision. Only thereafter the petitioner may or may not be aggrieved by the outcome of the proceedings. At present, there is no occasion for this Court to exercise any jurisdiction in favour of the petitioner. Writ petition is dismissed.
