This is a petition for grant of anticipatory bail for offence under Section 414 of the Indian Penal Code. Allegations against the petitioners is that stolen tractor and it's trailer was recovered from the house of the petitioners.
Submission of the learned counsel for the petitioners is that petitioners had purchased the same from Ashok Choubey and Shyam Choudhary, the initial owners of the tractor, which would be evident from Annexure 2. The petitioners have got no criminal antecedent.
Considering the aforesaid fact, let the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Chutia P.S. Case No. 5 of 2017 to the satisfaction of Smt. A. Gupta, Judicial Magistrate, 1st Class,
Patna High Court Cr.Misc. No.36231 of 2017 (2) dt.10-08-2017 2/2 Dehri-on-Sone, Rohtas, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
