JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Didarganj P.S. Case No. 86 of 2018 dated 07.06.2018 instituted for the offences under Section 420 of the Indian Penal Code, section 65 of the Copy Right Act, 1957 and Section 6(2)(e)/7 of the Environment Protection Act, 1986.

The petitioner, who is a young entrepreneur is alleged to have manufactured PVC pipes with ISI certification, in the absence of any clearance by the authority of the Indian Standards Institute.

The learned counsel for the petitioner has submitted that it was only a mistake on the part of the petitioner and no sooner he realized that such clearance was

So far as the offence under the Copy Right Act and the Environment Protection Act are concerned, learned counsel for the petitioner has submitted that no objection certificate has been obtained by the petitioner and the petitioner has the permission to establish and run the factory.

Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-cum-Additional Chief Judicial Magistrate, Patna City in connection with Didarganj P.S. Case No. 86 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
