02. In the present case, the petitioner seeks bail in connection with Harsidhi P.S. Case No. 211 of 2025 registered for the alleged offences under Sections 317(2), 318(4), 336(3) and 3(5) of Bharatiya Nyaya Sanhita, 2023.

03. As per prosecution case, the petitioner and coaccused were found dealing with stolen vehicles and four four wheelers were seized from the houses of the petitioner and coaccused.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The recovered Bolero vehicles were standing on the road and not at the house of the petitioner and the petitioner has no

The petitioner was in his house and was having no knowledge about the vehicles parked in front of his house. In fact, nothing incriminating has been recovered from the person or possession of the petitioner. Learned counsel further submits that similarly placed co-accused, Rajeshwar Das, has been granted bail by a Co-ordinate Bench vide order dated 12.08.2025 passed in Criminal Misc. No. 56452 of 2025 and the case of this petitioner is on exactly similar footing. The petitioner is in custody since 18.04.2025 and charge-sheet has been submitted. The petitioner is having clean antecedent.

05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 211 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
