JUSTICE SATYAVRAT VERMA ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Bairgania P.S. Case No. 56 of 2021, instituted for the offences under Sections 30(a), 30(C) and 30(D) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 07.08.2021, he is a person with clean antecedent, charge-sheet has been submitted in this case and allegation is of recovery of 292.500 litres of Nepali Saufi wine from the house of the petitioner.

The learned counsel for the petitioner submits that though the house belongs to the petitioner but the same has been taken on rent.

Considering the fact that petitioner is in custody since 07.08.2021, he is a person with clean antecedent, charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5,000/- (Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Special Judge (Excise), Sitamarhi, in connection with Bairgania P.S. Case No. 56 of 2021.

The application stands allowed.
