Heard learned counsel for the petitioners and learned APP for the State.
Petitioners seek bail in a case registered for the offences punishable under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016.
993 litres of liquor was recovered from a pick-up van and the petitioners were driver and the cleaner of that van. Petitioners are in custody since 30.09.2020. They have stated on oath that they have got no criminal antecedent. Investigation of the case against the petitioners is already complete. Considering the facts aforesaid, let the petitioners,
Patna High Court CR. MISC. No.1150 of 2021(2) dt.10-03-2021 2/2 above named, be released on bail, after framing of the charges so that the trial may not hamper, on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Police Station Case No. 382 of 2020 (CIS-382/2020), subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.
(b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
(c) The petitioners shall not leave the country without permission of the learned trial court.
