2. Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.

3. The petitioner has preferred this application for grant of regular bail in connection with Industrial Area P.S. Case No. 27 of 2023 dated 07.03.2023 registered for the offences punishable under Sections 20, 22, 24 and 27 of the N.D.P.S. Act.

4. As per the prosecution case, 25 mg Brownsugar kept in capsule and 1.87 mg Smack kept in puria were recovered from the pocket of the petitioner.

5. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.50528 of 2023(2) dt.16-08-2023 2/2 that the petitioner is innocent and has falsely been implicated in this case due to ulterior motive. He further submits that the seized contravened is in small quantity. The petitioner has clear antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 09.03.2023.

6. Learned Additional Public Prosecutor for the State has vehemently opposed the bail petition of the petitioner. 7.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge, NDPS Act, Vaishali at Hajipur, in connection with Industrial Area P.S. Case No. 27 of 2023.

8. The application stands allowed.
