====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-08-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code.

3. The petitioner is alleged to have obtained appointment, as Panchayat Teacher, on the basis of forged and fabricated document(s).

4. It is submitted on behalf of petitioner that petitioner was appointed, as Panchayat Teacher, after investigation of all her educational certificates by the concerned department, but later on, same have been declared as forged and fabricated without proper verification or giving any notice to the petitioner.

Patna High Court CR. MISC. No.49317 of 2024(2) dt.08-08-2024 2/2 Moreover, petitioner has already been terminated from service vide Letter No. 61 dated 25.06.2024 issued by Panchayat Secretary-cum-member secretary of the Panchayat Appointment Unit, Mohamadpur, Biharshariff (Annexure-P2).

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail.

Considering the fact that petitioner has already been terminated from the service, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharshariff in connection with G.R. No. 6528 of 2023 arising out of Biharshariff P. S. Case No. 1039 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
