Learned counsel for the petitioner undertake to remove the defects within three weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner seeks bail in a case registered for the offence punishable under Section 363/366A of the Indian Penal Code and Section 8 of Protection of Children from Sexual Offences (POCSO), Act.

Allegation against the petitioner is that he kidnapped the daughter of the informant and grab the money on the pretext of marriage.

Learned counsel for the petitioner submits that

The statement of victim was recorded under Section 164 of Cr.P.C. where she stated that she herself fled away with the petitioner and got married on the same very day. She further stated that she wants to go and stay with the petitioner. He submits that age of the victim was assessed by the Medical Board as 17 to 19 years. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 16.09.2020. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Sathi P.S. Case No. 36 of 2020.
