The petitioner apprehends his arrest in connection with S.T. Excise No.02/19, arising out of Kunauli (Dagmara O.P.) P.S. Case No.61/18 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The police got information that some persons coming on a motorcycle inside the Indian territory after purchasing wine from Nepal. The police intercepted the motorcycle but the motorcyclists managed to flee away. From the motorcycle, 420 bottles each containing 300 ml. nepali liquor was recovered. It appears that petitioner is the owner of the motorcycle and it was he who was driving the motorcycle carrying liquor.

Taking into consideration the facts aforesaid, I am not

Patna High Court CR. MISC. No.45250 of 2019(2) dt.23-07-2019 2/2 inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
