This application for anticipatory bail arises out of Sabour P.S. Case N0. 153 of 2017, disclosing offences under Sections 147,148,149,341,323,326,307,379,452.504.506 of the Indian Penal Code.

Considering the submission that other similarly situated coaccused person has been granted anticipatory bail by this Court by an order, dated 10.10.2017 passed in Cr. Misc. No. 42165 of 2017, this application is allowed.

Learned counsel for the Informant has, however, submitted that the said Aman Kumar Nirala has wrongly been granted anticipatory bail by this Court. The said plea cannot be entertained by this Court.

Patna High Court Cr.Misc. No.48808 of 2017(2) dt.03-11-2017 2/2 Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateX, Bhagalpur in Sabour P.S. Case No. 153 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
