2. The present petition has been preferred for transfer of Matrimonial Case being HMA Case No.1106 of 2022 from the Court of learned Principal Judge, Family Court, Patna to the Court of learned Principal Judge, Family Court, Samastipur.
3. The sole opposite party has preferred Matrimonial Case No. 1106/2022 before the learned Principal Judge, Patna and the petitioner wants that the same be transferred to the Court of learned Principal Judge, Family Court, Samastipur on the ground that she is with her parents, is economically
Patna High Court MJC No.1919 of 2023(6) dt.22-08-2024 2/2 depended upon them. Further, she has threat her life at Patna from the side of the opposite party.
4. Mr. Ravindera Kumar, learned counsel for the opposite party fairly submits that the husband do not have any objection to the transfer but only wants to its early conclusion. He further submits that the opposite party may be allowed to appear either physically or through the virtual mode.
5. In view of the fair stand taken by the opposite party, the Matrimonial Case being HMA Case No.1106 of 2022 is transferred from the Court of learned Principal Judge, Family Court, Patna to the Court of learned Principal Judge, Family Court, Samastipur with the liberty to both the parties to appear either physically or through the virtual mode.
6. The MJC No. 1919 of 2023 is allowed.
