The petitioner seeks bail in a case registered for the offence punishable under Section 302 of the IPC. Earlier, the prayer for bail of these petitioner was rejected vide order dated 20.1.2021 passed in Cr. Misc. No.32690 of 2020.

The petitioner has now filed this application for bail and vide order dated 06.10.2021, a report was called regarding the stage of trial.

In compliance thereof, a report kept at flag 'R' dated 22.10.2021 has been sent by the learned Additional Sessions Judge-III cum Spl.Judge (M.P./M.L.A.), Bettiah, West Champaran, whereby it is submitted that the trial is likely to be concluded within a period of two years.

No.57256 of 2021(3) dt.17-11-2021 2/2 Considering the submissions made in the report, I am not inclined to grant bail to the petitioner named above, in connection with Bettiah Mufassil P.S. Case No.437/19. The instant bail application is hereby dismissed. However, the learned trial court is directed to conclude the trial as expeditiously as possible, preferably within a period of one year from the date of production of a copy of this order. The Superintendent of Police, West Champaran is directed to take steps for production of all prosecution witnesses for their examination as and when the date is fixed, so that the trial may be concluded within the time indicated herein above.
