JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 20.09.2014 in a case registered for the offences punishable under Sections 376, 379 of the Indian Penal Code.

Admittedly, the informant originally filed complaint case which was converted into the above stated police case. From bare perusal of contents of first information report it appears that the informant was a consenting party.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town

However, it is made clear that observation given in this order is only for the purpose of bail.
