Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307, 324 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, petitioner No.1 is alleged to have assaulted the son of informant by means of Garasa which hit on his head whereas petitioner No.2 assaulted him with iron rod.

Learned counsel appearing for the petitioners submits that on account of petty dispute some scuffle took place in which both sides sustained injuries. There is case and counter

Patna High Court CR. MISC. No.57243 of 2021(4) dt.07-11-2022 2/2 case. One lacerated wound has been found by the doctor and opinion about nature of injury has been kept reserved. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and and the backdrop in which the scuffle took place, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut PS case No. 602/ 2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
