The petitioner seeks bail in Maner P.S. Case No. 462 of 2013 for the offence under Section 366(A) of the Indian Penal Code.
Shiv Jhari Devi, the mother of the victim, alleged that her daughter Punam Kumari went outside her house to attend the call of nature but she did not return.
Learned counsel for the petitioner submits that the victim is in love with the petitioner. The victim made her statement under Section 164 Cr.P.C. wherein she disclosed that she had voluntarily left along with the petitioner to Delhi. The doctor assessed her age to be between 17 to 19 years. Having considered the facts that the victim herself
Patna High Court Cr.Misc. No.52210 of 2014 (2) dt.07-01-2015 2/2 disclosed that she went along with the petitioner to Delhi and it appears that she did not raise any alarm, the victim appears to be a consenting party and the doctor has assessed her age to be between 17 to 19 years, the petitioner named above is directed to be released on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur at Patna in Maner P.S. Case No. 462 of 2013.
