Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sasaram Town (Darigaon) P.S. Case No. 92 of 2022 lodged under Section 392 of the I.P.C.

As per the allegation, F.I.R. has been lodged against three unknown persons for robbery of Maruti Omni Van. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and his name has figured in this case by virtue of the confessional statement of the coaccused. Counsel further submits that there are three criminal

Patna High Court CR. MISC. No.47246 of 2022(3) dt.21-02-2023 2/2 cases pending against the petitioner and he is in custody since 22.04.2022.

Learned counsel for the State opposes the prayer for bail and submits that the name of the petitioner has come on the confessional statement of the co-accused and on the statement of the said co-accused, the looted Maruti Omni Van has also been recovered.

Upon specific query that whether charge has been framed or not, counsel for the petitioner submits that he is not aware that charge has been framed or not.

In this view of the matter, I am not inclined to grant bail to the petitioner. Accordingly, the bail petition of the petitioner is hereby rejected.

Liberty is hereby granted to the petitioner that he may renew his prayer for bail after framing of charge. (Dr. Anshuman, J.) ravishankar/- U
