2. The petitioner has preferred this application for grant of regular bail in connection with Dariyapur P.S. Case No. 456 of 2026, registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 117(2), 74, 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita.

3. As per the allegation, the petitioner and co-accused, Pintu Kumar, assaulted by means of iron rod upon the head of the brother of the informant, namely, Rajeshwar Rai, due to which he sustained head injury.

4. Learned counsel for the petitioner has submitted that there is case and counter case between the parties. It has further been submitted that the occurrence took place suddenly

It has further been submitted referring to Annexure-3, the injury sustained by injured, Rajeshwar Rai, which is opined to be simple in nature. It has lastly been submitted that petitioner is in custody since 30.05.2026, and he is accused in one another case, in which he is on bail.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

6. Heard the parties and perused the records.

7. Considering the facts and circumstances of the case as well as the period of custody, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Dariyapur P.S. Case No. 456 of 2026.

8. The application stands allowed.
