2 This application has been filed on behalf of the petitioner for grant of anticipatory bail, who is apprehending his arrest in connection with Sabour PS Case No 172 of 2025 registered for the offence punishable under Sections 126 (2), 115 (2), 109, 329 (4), 324 (4), 303 (2), 76, 351 (2), 352, 3 (5) of the BNS.

3 The allegation against the petitioner in the FIR is of assault upon the husband of the informant.

4 The learned counsel for the petitioner submits that the petitioner and the informant are Gotiya. There is land dispute between the parties. There are cases between the parties and the present is one other false implication. The earlier case is

Patna High Court CR. MISC. No.47459 of 2026(2) dt.24-07-2026 2/2 mentioned in paragraph 3 and that is a criminal antecedent of the petitioner as well. She has further submitted that the nature of injuries sustained by the informant and her husband is simple and the same has also been taken note by the learned Court below in the order impugned.

5 The learned counsel for the State vehemently opposed the prayer for bail.

6 Having considered the rival submissions, looking into the relationship, land dispute, nature of the injuries, I am inclined to grant anticipatory bail to the petitioner. 7 Let the petitioner above named, in the event of his arrest/surrender within a period of four weeks from today, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in Sabour PS Case No 172 of 2025 subject to all conditions as laid down under Section 482 (2) of the BNSS.
