JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 22.10.2014 in a case registered for the offences punishable under Sections 386 and 387 of the Indian Penal Code. It is alleged that four lacs rupees as extortion was demanded from the informant on 15.8.2014, 16.8.2014, 17.8.2014 and 18.8.2014 by different persons but ultimately the extortion was demanded by the petitioner on 9.10.2014.

It is submitted by the learned senior counsel for the petitioner that the FIR was registered on 13.10.2014 and even assuming the accusation no offence under sections 386 and 387 IPC is made out. The petitioner is accused in one other case in which he is on anticipatory bail and statement to the aforesaid effect has been made in paragraph 3 of the petition.
