JUSTICE SANJAY PRIYA ORAL ORDER 3/ 27-04-2018 This application under Section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 19.11.2014 passed by 5th Additional Sessions Judge, Vaishali at Hajipur, in Session Trial No.250 of 2013/ 19 of 2014 arising out of Vaishali P.S. Case No.06 of 2013 by which he has rejected the petition dated 10.03.2014 filed by the petitioner under Section 228 of Criminal Procedure Code for his discharge. A report was called for from the Court below about the present stage of the case, which has been received. It is mentioned in the report that Charge has already been framed in the case by order dated 10.03.2017 for the offence under Section(s) 353, 504, 506, 308, 379, 323, and 341 Indian

Patna High Court Cr.Misc. No.11175 of 2015 (3) dt.27-04-2018 2/2 Penal Code and the case is pending for evidence. In such circumstances, this Court is not inclined to interfere with the impugned order passed by the learned Court below.

This application is, accordingly, dismissed.
