The petitioner apprehends his arrest in connection with Raxaul P.S. Case No.102 of 2015 registered under Sections 409, 420, 120B/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The F.I.R. was lodged only against the proprietor of four Rice Millers. The petitioner was not named in the F.I.R. During investigation, the police submitted charge sheet against them but surprisingly after several years of petitioner's retirement, the petitioner has been implicated in this case, when S.I.T. was constituted, only

Patna High Court CR. MISC. No.51530 of 2023(2) dt.30-08-2023 2/2 because the petitioner was posted as Assistant Account Officer of S.F.C., Motihari at the relevant time. It is further submitted that the F.I.R. named accused persons, against whom the allegations were made, have already been granted anticipatory bail by this Court vide orders dated 23.07.2015, 23.07.2015, 17.08.2015 and 12.08.2015 passed in Cr.Misc.No.28643 of 2015, Cr.Misc.No28641 of 2015, Cr.Misc.No.32941 of 2015 and Cr.Misc.No.33410 of 2015 respectively (Annexure 2 series).

Having considered the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the court concerned Saran at Chapra in connection with Raxaul P.S. Case No.102 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
