2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 379 and 420 of the Indian Penal Code.
3. As per prosecution case, it is alleged that while informant came out of the A.T.M. without canceling the transaction, this petitioner was there and taking benefit of the situation, he illegally withdrew a sum of Rs. 25,000/- from the account of informant.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case merely on suspicion.
5. On the other hand, learned A.P.P. for the State has

No.53194 of 2024(2) dt.03-09-2024 2/2 vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he illegally withdrew money from account of informant. Petitioner has also got one criminal antecedent of similar nature.
6. Considering the aforesaid facts and circumstances, nature of accusation and fact that petitioner has got one criminal antecedent of similar nature, the prayer for grant of anticipatory bail to the petitioner is rejected.
