In this case, the petitioner is seeking anticipatory bail in connection with Complaint Case No.167 of 2014 (Trial No.699 of 2016) registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code and under Section 138 of the N.I. Act.

Allegation has been made against the petitioner that the cheques which were given to the complainant were bounced due to insufficient balance in the account of the petitioner.

No.26645 of 2017 (6) dt.17-08-2017 2/2 Considering the facts and circumstance of the case, let the petitioner-Kanhaiya Kumar Ranjan @ Kanhaiya Kumar Razak be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhabua (Kaimur), in connection with Complaint Case No.167 of 2014 (Trial No.699 of 2016) subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that the petitioner would deposit Rs.50,000/- before the Court below within four weeks from today and the Court below will deposit the aforesaid amount in a proper place so that it may earn maximum interest.
