The petitioner apprehends his arrest in Complaint case No. 149 of 2016 for the offences punishable under Section 420 of the Indian Penal Code and under Section 138 of the N. I. Act.

The complainant alleged that he purchased nine decimals of land from the petitioner but the petitioner had only seven decimals of land left because two decimals of land of the petitioner was acquired for widening the road. The complainant alleged that petitioner agreed to return Rs. two lacs but he did not return the money and cheque given by the petitioner was not honoured.

The petitioner sold the land to the complainant after receiving consideration amount. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Complaint case No.149 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
