The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
It is a case of recovery of about 19 liters of toddy and one liter of country made wine.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that no liquor was recovered from the conscious or constructive possession of the petitioner, petitioner has not been apprehended at the spot and the name of the petitioner has transpired at the instance of local Chaukidar. Petitioner has got clean antecedent.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, (Excise), Sitamarhi in connection with Parsauni P.S. Case No. 105 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
