Heard learned counsel for the petitioner.
The petitioner seeks bail in connection with Khudawan P.S. Case No.12 of 2013 registered for the offences punishable under sections 147, 149, 341, 323, 427, 435 and 384 of the Indian Penal Code, 27 of the Arms Act and 17 of the C.L.A. Act. It has been contended that the aforesaid case was registered against 10-15 unknown miscreants. In course of investigation, name of the petitioner transpired on the basis of confessional statement of co-accused. Several other co-accused having more or less identical allegation to that of the petitioner have already been granted bail by different orders passed by
Patna High Court Cr.Misc. No.51549 of 2014 (2) dt.03-03-2015 2/2 different Benches of this Court. One of the co-accused, namely, Umesh Yadav is said to have been granted bail vide order dated 5th August, 2014 passed in Cr. Misc. No.13183 of 2014 by a Bench of this court. A copy of the order passed in the aforesaid Cr. Misc. No.13183 of 2014 has been produced before me by the learned counsel for the petitioner.
Regard being had to the reasons assigned in the order dated 5th August, 2014 passed in Cr. Misc. No.13183 of 2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar in connection with Khudawan P.S. Case No.12 of 2013.
