JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 This appeal has been filed for grant of pre-arrest bail to the appellant in connection with Samastipur SC/ST P.S.Case No. 40 of 2016 registered for the offences under Sections 323, 341, 354, 504, 406 of the Indian Penal Code and 3(1)(x) of SC/ST Act and also for setting aside the order dated 28.11.2016 passed by 1st Additional District and Sessions Judge, Samastipur. Allegation against the appellant is that he abused the informant by taking her caste name.
Submission of learned counsel for the appellant is that petitioner is member of Panchayat Samiti and informant is Vikash Mitra and as appellant has filed a complaint against the informant the present case has been filed against him and, as such, he has falsely been implicated in this case and allegation of abusing by
Patna High Court CR. APP (SJ) No.274 of 2017 (4) dt.24-08-2017 2/2 taking caste name is false and concocted.
Heard learned Special P.P. who has opposed the prayer for pre-arrest bail stating that this appeal is not maintainable. In view of facts and circumstances, let appellant surrender and pray for regular bail, which shall be considered on the basis of submission made above as well as the materials available on record and the court below will pass an appropriate order, without being prejudiced by this order, if possible, on the same day.
