The petitioner apprehends his arrest in connection with Dumra P.S. Case No. 218 of 2017 registered under Sections 420, 406, 120-B, 467 and 468 of the Indian Penal Code. The accusation is that complainant/informant Geeta Devi and witness no. 2 Shiv Shankar Chaudhary purchased 21 decimals of land of Survey no. 381 and 19 decimals of land of Survey no. 393 on 02.08.2001. The same land was in their possession after purchase and got mutated the land bearing Jamabandi No. 4596. Accused Jalaludin Kha transferred 20 decimals of land to Md. Sarbarul Hoda, Akil Ahamad and Sahub
Patna High Court Cr.Misc. No.63987 of 2018(5) dt.31-01-2019 2/2 Alam on 18.03.2016 by a forged sale deed in which petitioner put his signature as a witness.
The learned counsel appearing on behalf of the petitioner submits that petitioner has been implicated in this case on the basis of his signature as witness on the aforesaid forged sale deed, which is said to be executed by accused no. 1 Jalaludin Kha in favour of accused no. 2 to 5, which is said to be the part of the land of the informant. Petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by them within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 218 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) sushma/- U T
