The petitioner apprehends his arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he received information regarding smuggling of iron rods and diesel by a tractor from Nepal by way of Yadav Tola Maheshpatti, it is next alleged that on seeing the police force at the place of occurrence the driver of the tractor fled and from the tractor 30 pieces of iron rod and 130 litres of diesel is alleged to have been recovered.

No.57165 of 2021(2) dt.06-07-2022 2/2 Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case, petitioner is the owner of the tractor and was completely unaware that his tractor was being misused by driver for some illegal purposes.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ghurna P.S. Case No. 285 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
