JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2022 Heard Mr. Sandip Kumar Gautam, learned Advocate for the petitioner and Mr. Jitendra Singh for the informant. The State is represented by Ms. Rita Verma, learned APP for the State.
The petitioner seeks bail in connection with Bakhri P.S. Case No. 179 of 2021 dated 27.06.2021 instituted for the offences under Sections 147, 149, 341, 323, 307, 325, 504 and 506 of the Indian Penal Code.
The allegation against the petitioner is of assaulting the informant on his hand which led to its fracture and also assaulting one Sanjeet Mahto along with two other persons.
The counsel for the informant, however, has submitted that after the informant was assaulted, the
Patna High Court CR. MISC. No.47539 of 2022(2) dt.16-12-2022 2/2 petitioner along with others continuously kept on assaulting the informant in a brutal manner.
The learned counsel for the petitioner, however, has submitted that the specific accusation is what has been noted above and that he is in custody since 19.05.2022.
Apart from this, it has been submitted that the petitioner does not have criminal antecedents. There is a counter version of the occurrence also.
The learned counsel for the petitioner therefore infers that because of such land dispute, accusations have been over exaggerated.
Be that as it may, considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Begusarai in connection with Bakhri P.S. Case No. 179 of 2021.
