JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This application, for grant of anticipatory bail, arises out of Bhagwanpur P.S. Case No. 31 of 2014, disclosing offences under Sections 304(B), 201/34 of the Indian Penal Code.
Petitioner happens to be mother in law and allegation against her and others is of causing dowry death of the deceased.
Submission of learned counsel for the petitioner is that she is mother in law and no specific allegation has been attributed to her and husband of the deceased has been in judicial custody. It has further been submitted that earlier the investigation was going on only against the husband of the deceased as such she did not appear.

Having heard both sides, considering the fact that the case is of the year 2014 and in spite of that the petitioner has moved this court for grant of anticipatory bail after four years, as such, I am not inclined to grant the privilege of anticipatory bail to the petitioner, however, she may move the court below for grant of regular bail, which will be dispose of by the court below on the basis of materials available on record, is possible on same day, without being prejudiced by this order.
