JUSTICE RAKESH KUMAR ORAL ORDER 13-03-2019 Heard Sri Mahendra Thakur, learned counsel for the petitioner and Sri Ranjeet Kumar Thakur, learned counsel, who has appeared on behalf of opposite party no. 2 (wife of petitioner).

On perusal of earlier order, it appears that the matter was referred to Patna High Court Mediation Centre and thereafter, a mediator's report has been received, which indicates that the dispute could not be resolved. Learned counsel for opposite party no. 2 submits that opposite party no -2 is not ready to reside with the petitioner. He further submits that opposite party no. 2 had filed maintenance

Patna High Court CR. MISC. No.63163 of 2018(4) dt.13-03-2019 2/2 case. Even despite the order, the petitioner is not making any payment.

Learned counsel for the petitioner submits that against the order, the petitioner has already filed a revision before this Court.

Considering the nature of accusation as well as dispute in between the parties, there is no reason to refuse the prayer for grant of anticipatory bail. Accordingly, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Chandan Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Vaishali at Hajipur in connection with Complaint Case No. 2421 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
