2. In this case, the petitioners are seeking regular bail in connection with Barauni (Zero Mile) P.S. Case No. 152
Patna High Court CR. MISC. No.49197 of 2024(2) dt.30-07-2024 2/3 of 2024, registered for the offences punishable under Sections 30(A) and 41(i) of Bihar Prohibition and Excise (Amendment) Act, 2018.
3. As per allegation, the police got a secret information that at Village-Papraur, Sanjay Kumar Rai and Vijay Rai (petitioners) with their associates have brought a large trip of wine near their house. On this information, the police party reached at the P.O. and caught the petitioners and co-accused Hitesh Kumar. On search, a huge quantity i.e., 96 litres of Codeine Phosphate and Triprolidine Hel Syrup, RTScan cough syrup recovered.

Learned counsel for the petitioners has submitted that the alleged contraband which was recovered from the house of the petitioners are medicines and cough syrups and the petitioner, Vijay Rai is a wholesaler of the medicines. His license has been annexed as Annexure-2 in Cr. Misc. No. 52580/2024. He is also paying GST regularly and the GST Registration Certificate has been annexed as page no. 27 of the bail petition. Further submission is that the petitioner Sanjay Kumar Rai is brother of the petitioner Vijay Rai. The alleged medicines were recovered from joint house of the petitioners.
5. The learned court below is directed to get the
Patna High Court CR. MISC. No.49197 of 2024(2) dt.30-07-2024 3/3 license and GST certificate verified by the concerned authorities and if they are found to be genuine, the petitioners, above-named, shall be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise 1st, Begusarai in connection with Barauni (Zero Mile) P.S. Case No. 152 of 2024.
6. With these observations, the criminal miscellaneous petition is disposed of.
