JUSTICE RAKESH KUMAR ORAL ORDER 05-03-2019 On call, none appeared either on behalf of the petitioner or the informant. Earlier by order dated 30-11-2018, a co-ordinate Bench of this Court had referred the matter to Patna High Court Mediation Center with direction that both parties shall remain physically present before the mediator on 14-12-2018. In the meanwhile, direction was given not to take any coercive step against the petitioner. On 08-01-2019, on joint prayer, the case was adjourned. On record, there is report of mediator dated 20-12-2018, which indicates that as per terms attached with the reports, dispute has mutually been settled. The settlement agreement is also dated 20-12-2018, which bears left thumb impression (L.T.I.) of the petitioner and signature of the complainant, which is reflected on the memorandum of agreement.

Accordingly, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Md. Hasim be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Barsoi P.S. Case No. 174 of 2018 subject to condition as laid down in the memorandum of agreement, which has been agreed upon in between the parties before the mediator as enclosed with the mediator's report.

The petition stands disposed of.
