JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 17.10.2014 in a case registered for the offences punishable under Sections 406, 420/34 of the Indian Penal Code.

The accusation against the petitioner is that he got opened bank account in the name of his brother but pasted his own photograph on the application and subsequently, withdrew Rs. 50,000/- which had been sanctioned in the name of his brother for construction of Indira Awas. Moreover, in the first information report itself, it has been admitted by the informant that the petitioner has already deposited Rs. 50,000/- in the Nazarat. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
