The petitioner apprehends his arrest in Daudnagar P.S. Case No.393 of 2021 registered under Sections 30(a) and 36 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case merely because he is the owner of the alleged vehicle. It is further submitted that nothing has been recovered from possession of the petitioner. There is no statement of the driver of the vehicle regarding involvement of the petitioner in the alleged recovery. The petitioner has got no criminal antecedent. (2) of the Code of Criminal Procedure.
