In course of investigation of this case, some looted articles were recovered from the godown of the petitioner but it would appear from perusal of different paragraphs of the case diary that one Akhtar and his other family members had kept looted articles at different places and handed over the same to some other persons from where said articles were recovered in course of investigation. The contention on behalf of the petitioner is that petitioner is owner of the godown from which alleged recovery is said to have been made but he had given the aforesaid godown on rent to the above stated co-accused Akhtar and the aforesaid fact was disclosed by the petitioner when his confessional statement was recorded before police. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 29.8.2014.
Patna High Court Cr.Misc. No.51325 of 2014 (6) dt.08-09-2015 Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Atul Kumar Singh, Judicial Magistrate, Ist Class, Samastipur/ concerned court in N.H. Bangra P.S. Case no. 93/2014.
