2. The petitioner apprehends arrest in connection with Ara Nagar PS Case No. 329 of 2015 dated 27-07-2015 instituted for the offence punishable under Sections 467, 468, 471, 409, 420 and 120B of the Indian Penal Code.

3. Allegation against the petitioner is that on the basis of forged B. Ed certificate, she got herself appointed as Panchayat teacher.

4. Learned counsel for the petitioners submits that the petitioner is innocent and she has been falsely implicated in this case. It is further submitted that petitioner was appointed on 30-11-2006 and since then she was working. On 28-05-2008,

No.55193 of 2024(2) dt.31-08-2024 2/3 the District Education Officer, Bhojpur, Ara, sent the mark-sheet of the petitioner for verification to the University in-question and pursuant to the same, Examination Controller of University vide letter No. 510C, dated 19-09-2008 wherein, petitioner's name has appeared at Serial No. 3, informed the District Education Officer, Bhojpur, Ara that the candidate has failed, and as such, mark sheet is forged one. Thereafter, the petitioner was constrained to serve a legal notice to the Examination Controller of the University and in response to which, Examination Controller of the University issued letter dated 14-09-2009 stating therein that the said letter dated 19-09-2008 had been written mistakenly and same has been forwarded to the District Education Officer, Bhojpur Ara.

On 10-11-2008, the petitioner was restrained to mark signature on the attendance register and thereafter, the petitioner left the school and subsequently, she had married and residing at her matrimonial home, and as such, she had no knowledge about the case. Lastly, it has been submitted that petitioner has no criminal antecedents.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Ara Nagar PS Case No. 329 of 2015 petitioner shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Bhojpur at Ara, subject to condition as laid down under Section 438(2) of the Cr.P.C.
