JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 07.04.2014 in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code, 25(1-b) a, 26, 35 of the Arms Act and 3, 4 of Explosive Substance Act.

It is alleged that one country made pistol and two live cartridges were recovered from conscious possession of the petitioner when he was arrested by the police officials. At the very outset, it is pointed out on behalf of the petitioner that having similar allegation, co-accused, Nahid @ Abdul has already been granted privilege of bail by this court vide order dated 05.01.2015 passed in Cr. Misc. No. 51806 of 2014. Considering the aforesaid facts and circumstances as

No.579 of 2015 (2) dt.08-01-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 178 of 2014.
