JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-03-2019 Learned counsel for the petitioner seeks permission to withdraw the present application with a liberty to move before the learned Sessions Judge afresh.

It appears that the petitioner's anticipatory bail application preferred in Complaint Case No. 923 C of 2011was rejected vide order dated 11.11.2011 passed in A.B.P. No.4896 of 2011 by the learned Sessions Judge, Patna, but the said order is not available on record. It is reported to be destroyed. Hence, the anticipatory bail application of the petitioner is not being treated as defect free. In the circumstances, this application is permitted to be withdrawn with a liberty to the petitioner to file a fresh application before the learned Sessions Judge.
