2. This application has been filed for the direction to the respondents to shift the public bus stand from main Bazar, Jandaha to any other uncrowded place outside the main market since presently the respondent nos. 3 and 4 are operating the public bus stand in the center of the main market on the road.

3. The supplementary affidavit filed by the State has been taken on record.

4. The contention of the petitioner that the bus stand may be shifted outside the town and the petitioner wants

Patna High Court CWJC No.10917 of 2023(4) dt.16-01-2024 2/2 positive direction with this Court with regard to same.

5. I have heard the learned counsel for the Zila Parisad, learned counsel for the State and the intervenor. The DDC who is the Chief Executive Officer of Zila Parisad has also appeared in person.

6. It has been pointed out by the respondent and the intervenor that the bus stand is running since last many years on a plot which has been approved by the Regional Transport Authority i.e., R.T.A. They further submits that any shifting of the bus stand can only be ordered by the R.T.A and this is also a policy matter which cannot be interfered because of the application of some citizen.

7. Accordingly, this application is disposed of with liberty to the petitioner to approach the appropriate authority including R.T.A for shifting of bus stand and if the authorities find merit in the representation of the petitioner they may take decision in this regard.
