The petitioner is not named in the F.I.R. The informant filed protest petition after two weeks of the occurrence, but she did not name the petitioner. During the course of investigation, some of the witnesses only suspected that the deceased had illicit relation with the mother-in-law of the petitioner, and the deceased also developed illicit relation with the wife of the petitioner. It is submitted that there is no tangible evidence. The mobile of the deceased was found used by Ranjay Das and not the petitioner.

Considering the aforesaid facts, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Udakishanganj P.S.Case No. 56 of 2014.
