The petitioners seek pre-arrest bail in Khagaria (Muffasil) P.S.No.260 of 2018 registered under Sections 147, 149, 341, 323, 379, 504, 308 of the I.P.C.

Accusation is that altogether eight accused persons named in the F.I.R. including the petitioners came to the door of the informant and started to abuse him and when the informant made protest upon which they assaulted him causing injuries due to which he became unconscious. At that time they also snatched gold ring from the neck of the wife of the informant. Learned counsel for the petitioners submits that, in fact, due to dispute regarding passage occurrence took place in

No.66999 of 2018(3) dt.04-02-2019 2/2 which petitioners' side also sustained injuries regarding which Khagaria (Muffasi) P.S.Case No.257 of 2018 was instituted by petitioner no.1Devniti Yadav. Morever, the injuries as found on the person of the informant is simple in nature which would appear from injury report attached with the case diary. Having considered the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest of surrender before the learned court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Khagaria, in Khagaria (Muffasil) P.S. Case No.260 of 2018 subject to the condition as laid down under Section 438(2) of Cr.P.C.
