The petitioner is languishing in custody for the offence punishable under Section 304B/34 of the Indian Penal Code.

Petitioner is younger brother of the husband of the victim of dowry death. Marriage was solemnized six years prior to unnatural death. Allegation is of torture for non-fulfillment of dowry demand and commission of dowry death by throttling the victim. The doctor has found a case of strangulation. Submission is that all the family members have been roped in this case falsely and the death might have been result of some quarrel between the two spouse after six years of

Patna High Court CR. MISC. No.44892 of 2019(3) dt.30-09-2019 2/2 marriage. The petitioner is in custody since 26.03.2019. Investigation of the case is already complete. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sahar P.S. Case No.70 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
