The petitioner seeks bail in connection with Hathauri P.S. Case No. 67/19 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

According to the prosecution case, 2797.56 litres of liquor was recovered from an orchard. So far as the petitioner is concerned, he is sought to be prosecuted on the basis of statement of the Chowkidar that he was found running away from the place of raid.

Regard being had to the nature of accusation and taking into account his clean records as well as the period of custody which is from 30.07.2021, the petitioner, above named,

Patna High Court CR. MISC.
