JUSTICE ARUN KUMAR ORAL ORDER 11-08-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 419, 420, 467, 463, 471 of the Indian Penal Code and Section 66 I.T. Act, 2008 and 18(A) 18(B), 18(C), 27(C), 28(A), 28(B) II, 33 EEC(B), 33(I) of Drugs and Cosmetic Act, 1940 and under Sections 3, 4, 5, 7, 9(A) of the Magic Remedies Act, 1954..
Allegation in brief is that the accused persons used to cheat the general public by selling medicines claiming to cure many deceases and some postal materials, A.T.m. Cards, Auto Call Record, Magic Ear Ring were recovered.
It is submitted that the recovery was made from the house of one Brahmdev Chaudhary and the petitioner is son of him and Brahmdev Chaudhary has been granted anticipatory bail
Patna High Court Cr.Misc. No.37319 of 2017 (3) dt.11-08-2017 2/2 by a Co-ordinate Bench of this Court by Cr. Misc. No.30824 of 2017.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Mukesh Chaudhary be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda in connection with Giriyak (Katarisarai) P.S. Case No.142 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
