JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-05-2019 This is an application for grant of anticipatory bail in connection with C.R. No. 478 of 2017, T.R. No. 1518 of 2018, disclosing offences under Section 498(A) of the Indian Penal Code.

Allegation as per complaint petition against the petitioner is of demand of Rs.50,000/- from the complainant and ousted her from the house.

After appearance of opposite party no.2 as the parties have expressed their willingness to explore the possibility of living together harmoniously vide order dated 14.02.2019 the matter was referred to the Mediation Center, Patna High Court, Patna and the report of the learned Mediator is available at Flag

Patna High Court CR. MISC. No.63941 of 2018(5) dt.17-05-2019 2/2 'D' that shows that petitioner has appeared and the opposite party no.2 has absent and as such the dispute could not be settle and the mediation is failed.

Submission of learned counsel for the petitioner is that the allegation is false and concocted and he is still ready to keep her with full dignity and care.

Nobody appears on behalf of the opposite party no.2, though she has already appeared by filing vakalatnama. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Dalsinghsarai, District-Samastipur, in connection with C.R. No. 478 of 2017, T.R. No. 1518 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
